Federal courts do this whenever possible nowadays, especially when indivdual
rights are invoked. When it comes to helping the big guys, however, they are
more understanding.
One way or the other, by the time the cases go back to state court in
Massachusetts and then (possibly) get up to federal court (again), the
damages have been done to the kids.
Could it be that legislative action would be a more productive use of the
same resources?
[Remember: We at Substance are in federal court because the Chicago Board of
Education sued Substance and me for $1 million plus charging "copyright
infringement." So far, as I reported to the audience at our Second City
benefit November 10, we have paid our various lawyers (one of whom sold me
out and was dropped) $123,000 on those cases since we were sued on January
26, 1999. Chicago has already spent more than $500,000 (including $250,000 on
outside talent) persecuting Substance and me. Very few people have 2,000
friends -- as we've found -- to contribute to an ongoing legal defense fund.
We have no choice, since they have taken away my job and tried to destroy
this newspaper in their push for complete totalitarian control of all
information in this town. Others should weigh their options. We strongly
recommend that people try political organizing before bogging themselves down
in the courts, federal or local. This has been our suggestion for the past
four years here on ARN, although it still seems that many people have an
idealized version -- based on the myths of the Warrne Supreme Court -- of
what the federal courts will do for the little guy?]
