Not necessarily. The rule constrains schools, not parents and kids. The
rule says that districts are required to assess all their students. The rule
does not say that parents can not choose to have their kids skip the tests.
Note that my comment is based on my reading of what you posted, and not on
conversation with Montana officials or reading other of their policies.
