I'm forwarding an important email from NEA that boils down to this: if NCLB
isn't acted on, then even if it isn't reauthorized its provisions will remain
in effect. (The email was forwarded to me and other CTA State Council members
by the CTA board member for our district, Eric Heins).

Status of No Child Left Behind Act Absent a Reauthorization
With Congress preparing for a month-long August recess followed by a short
session and an adjournment scheduled for late September, it seems extremely
likely that the 110th Congress will conclude without reauthorizing the No
Child Left Behind Act. However, even without a reauthorization, the Act's
provisions will not expire and will remain in effect in perpetuity, unless
and until Congress repeals or modifies them.
Technically, funding for NCLB programs has been extended through the current
fiscal year, which expires September 30, 2008. Therefore, unless Congress
again extends the funding, it will be considered "unauthorized" starting in
the next fiscal year. However, Congress can, and indeed routinely does,
appropriate funds for unauthorized programs. Thus, Congress will continue
NCLB programs by providing funding for them, even after their funding
authorization has expired.
In short, failure to reauthorize the Act does not mean that NCLB provisions
will go away.
